Terms of Service

1. About us

Pretty by Kate ("Pretty by Kate", "we", "us") is operated by Kate Campbell, a sole trader trading as Pretty by Kate. By using our website at prettybykate.com or purchasing any of our travel guides, you agree to these Terms of Service. If you do not agree, please do not use the service.

2. The service

We sell personalised, interactive digital travel guides for specific destinations. After purchase you receive an unlock code which redeems into a generated guide on your account.

3. Your account

You must provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account. If you are using the service on behalf of an organisation, you confirm you have authority to bind that organisation. Individuals must be of legal age in their country of residence.

4. Acceptable use

You must not:

  • use the service for unlawful purposes, fraud, or spam;
  • infringe anyone's intellectual property or other rights;
  • interfere with the security or operation of the service, including probing, scanning, scraping, or distributing malware;
  • resell, redistribute, or sublicense our guides without our written permission;
  • reverse-engineer or circumvent any technical limits of the service.

5. Payments, billing and refunds

All purchases of Pretty by Kate guides are made through our Etsy shop. Payment, billing, tax and order handling are governed by Etsy's buyer terms at checkout. After purchase you'll receive an unlock code you can redeem here to activate your guide.

6. Intellectual property

All content, software, branding, and design that make up Pretty by Kate — including guide templates, written content, illustrations and UI — are owned by Kate Campbell and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to access and use the guides you purchase for personal, non-commercial use.

7. AI-generated content

Parts of our guides are generated using AI based on your inputs (destination, dates, preferences). AI outputs may contain inaccuracies, including outdated opening hours, prices, or local information. You are responsible for verifying anything important — particularly visas, travel restrictions, safety information, and bookings — before relying on it. The guides are for general informational purposes only and are not professional travel, medical, legal or financial advice.

You are responsible for your prompts and for any content you input. You must not use the service to generate illegal content, hateful or harassing material, or content that infringes anyone's rights. We may remove, refuse to generate, or filter outputs, and suspend accounts that violate these terms.

8. Your content

You grant us a limited licence to host and process the inputs you provide (such as trip details and preferences) solely to deliver and improve the service.

9. Service availability

We work hard to keep Pretty by Kate available, but we do not guarantee uninterrupted or error-free performance. We may modify, suspend or discontinue parts of the service at any time.

10. Warranties and liability

To the fullest extent permitted by law, the service is provided "as is" and we disclaim all implied warranties (including merchantability and fitness for a particular purpose). Our aggregate liability for any claim arising from the service is limited to the fees you have paid us in the 12 months preceding the claim. We are not liable for indirect, consequential or special damages, including lost profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify and hold us harmless from any claims arising from your content, your use of the service in breach of these terms, or your unlawful conduct.

12. Suspension and termination

We may suspend or terminate your access to the service for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the service ends; previously generated guides remain accessible to the extent reasonably possible.

13. Governing law

These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer-protection law in your country of residence requires otherwise.

14. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Continued use of the service after changes take effect constitutes acceptance.
